Bidders Acknowledgement & Terms of the Auction Sale

1.  All prospective bidders must register with a clerk at the auction to obtain a bidder number.  Bidding is by number only.  A $300 bidder deposit is required at the time of registration.  All bidder deposits will be automatically canceled if no purchases are made during the auction.  Please maintain possession of your bidder number at all times.  We will be open for bidder registration at the auction on Friday, June 4, 2010 and Saturday, June 5, 2010, from 9:00 a.m. until 6:00 p.m. or the completion of the auction.  

2.  If you plan on being an absentee bidder, please contact Bator International, Inc. at their Ojai, CA office at (805) 646-9566 before Wednesday, June 3rd, to pre-qualify and fill out the absentee bidder form.  Otherwise, you can contact the auction office beginning on Thursday, June 3rd from 1:00 to 5:00 p.m., Friday, June 4th from 9:00 a.m. to 5:00 p.m. and Saturday, June 5th from 9:00 a.m. until the conclusion of the auction.  The phone/fax number at the auction facility is 626-844-6038.  Please note that if you have not been a telephone bidder with Bator International, Inc. before, a wire transfer deposit of $5,000 is required at least 24 hours before the start of the auction.  If no bids are won, absentee bidder deposits will be returned via wire transfer on Monday, June 7, 2010.

3. All sales are final. All items are sold AS IS WHERE IS.  All items become the sole responsibility of the buyer (bidder) when the auctioneer announces "Sold".  Bator International Auctions is not responsible for damage or theft to sold items once the successful bidder has been announced.

4. Buyers fee is 13% per lot with a 3% discount for cash, wire transfers, cashiers checks or personal or company checks with pre-approval and current bank letter of guarantee on file.  CLICK HERE for a Sample Bank Letter of Guarantee.  The minimum buyer's fee is $125 per lot.                 

5. Bidders are responsible to know what they are bidding on.  At the time of the sale, we will describe the item as honestly as possible.  We receive much of our information from the seller and will also disclose any discrepancies that we see, however, this must not be interpreted as any form of warranty or guarantee as to the age, condition or authenticity.  There is no buyer's remorse or cooling down period and absolutely no returning of any item for any reason whatsoever.  Winning a bid at auction constitutes a legal and binding contract in which you are legally bound to pay for all items for which you are the recorded buyer of and for which the auctioneer announces as having been sold to you.  Should a bidder default upon his/her purchase (s) in any manner whatsoever (NSF, stop payment order, non payment, etc.), all bidder deposits left with Bator International Auctions will be forfeited, and the buyer agrees to pay Bator International Auctions the full sum equal to the purchase price, buyer's fee and any additional costs involved in any legal action, transportation, storage and resale of items not paid for.  The sum due and payable without relief.  

6. In the case of a tie bid or if the auctioneer feels that he missed a legitimate bid, the auctioneer may, at his discretion, put the item back up between the two bidders.            

7. Buyer payments must be made with good funds which are defined as cash, bank wire transfers, cashiers checks, travelers checks, personal or company checks (pre-approved by the auction office and backed by a current dated bank letter of guarantee) or Mastercard, Visa and Discover credit cards .  Bank title drafts are not acceptable.  There is a 3% discount for cash, bank wire transfers, cashiers checks and personal or company checks with pre-approval and bank letter of guarantee.  Please contact our office at 805-646-9566 to qualify for check approval.

8. All purchases must be paid for by the end of the auction day and must be removed from the auction facility no later than noon on Sunday, June 6, 2010.  If a buyer is paying by wire transfer, any and all items will be transported to a storage facility and held at the buyers expense until funds are received.  Any items left in the auction facility after Sunday at noon will be removed to a storage facility and the owner will be charged for all fees incurred by Bator International Auctions including but not limited to transportation and storage of said items.

9. If the vehicle is sold on a "Bill of Sale Only", buyer accepts all responsibility and cost in obtaining a title and/or registration in their particular state or country.  We will have a DMV representative on staff in the auction office.

10. Licensed motor vehicle dealers must supply copies of state dealer’s license and sales tax certificate.  Such dealers will pay any legal city or state sales or other tax assessed due to their failure to qualify from paying said tax at time of sale.

11. Unless the motorcycle is being transported out of the state by commercial carrier (you must bring your Bill of Lading to the office with you upon cashing out), the current California Sales Tax will be collected by the auction office.
